Obtaining your Texas Sales & Use Tax Permit

and why you need it

First and foremost, it is important to know that there is no fee for a Sales & Use Tax Permit. This permit will allow you to register for the Sales & Use Tax, 911 Surcharge and Fees as well as the Sales Tax Surcharge on Diesel Equipment.

A Texas Sales & Use Tax permit is required if your business:

  • Sells, leases or rents taxable goods.
  • provides taxable services.
  • acquire taxable goods and services from out of state suppliers that do not have a Texas Sales & Use Tax Permit.

You are not required to get a permit if your business:

  • purchases items at wholesale prices.
  • purchasing items with an ag/timber exemption number for the production of agricultural or timber products.

HOW TO APPLY AND WHAT ARE THE REQUIREMENTS?

As mentioned above getting a sales tax permit is free. You can apply for a permit online or you can print the application and mail it to the Comptroller.

To complete the application, you must:

  • be at least 18 years old (a guardian/parent may apply for a permit on behalf of a minor).
  • provide the social security number of the owner, partners, directors and officers.
  • know your businesses NAICS Code.
  • provide your Texas corporation’s file number from the Texas Secretary of State.

YOU RECEIVED YOUR SALES TAX PERMIT, WHAT’S NEXT?

After your permit has been approved you will be notified by letter if you will file your taxes monthly or quarterly. The due date generally falls on the 20th of each month unless it falls on a weekend or holiday, in which case it will be due the following working day. Quarterly filers will file in 3-month periods for example 1st quarter will include the months January, February and March, this period will be due on April 20th.

Discounts & Penalties

If you file and pay timely you can claim a 5% discount on the amount of tax. If you file late there is a $50 penalty if the report is filed after the due date. There is also a 5% penalty assessed if the tax is paid 1-30 days after the due date and a 10% penalty if it’s paid 30 days after the due date, interest will be charged after 61 days.
