Due to the complex Sales and Use Tax laws for various types of industries many business owners are unaware that they have overpaid in taxes or that certain jobs are tax exempt. You can file for a refund from the state if you are a permitted seller of a taxable item or a permitted purchaser of a taxable item.
When filing a claim you must identity the period in which the overpayment was made, generally this period is within four years from the date it was due and payable. You will also need supporting documentation, this includes:
- purchaser or sellers name
- copy of invoice
- specific reason for the refund
- resale, exemption, and direct pay certificates
- proof of payment
When you file for a refund claim it will either get approved or denied. If a claim is approved the comptroller will make a check to the company or person that is entitled to the refund, direct deposit is also available. Be aware that there are certain factors that can affect the amount that is returned.
If the claim is denied or only partially granted the comptroller will notify the claimant with the reason for denial. You can request a refund hearing, the state will then give you 6 months to gather additional documentation that is required to verify the claim. Documents that are not submitted in time can no longer be submitted during the refund hearing.
